1. Acceptance of Terms
This is a legally binding agreement between you (the “Client,” “Customer,” or “User”) and 333 CLASSICS LLC (dba “333Classics”, “we,” “us,” or “our”). By accessing our website (333classics.com), requesting a towing or transport quote, or engaging our services, you acknowledge that you have read, understood, and expressly agree to be bound by these Terms and Conditions in their entirety. These Terms apply to all towing and transportation services provided directly by 333Classics. Your continued use of our services following any updates to these Terms constitutes your acceptance of those changes.
2. Scope of Services & Brokerage Disclosure
333Classics is a licensed and insured Motor Carrier.We provide professional towing and vehicle transportation services using our own fleet of equipment and company-employed or contracted drivers.
- Direct Service Provider: Unlike a broker, 333Classics is directly responsible for the physical handling and transportation of your vehicle from the point of pickup to the point of delivery.
- Equipment and Access: The Client must ensure that the vehicle is accessible and in the condition described during the quote process. We reserve the right to use any equipment (e.g., flatbed, wheel-lift) deemed necessary for the safe transport of the vehicle.
- Operational Delays: While we strive for punctuality, all pickup and delivery times are estimates. 333Classics shall not be liable for delays caused by traffic, weather, road closures, mechanical issues, or government inspections. We are not responsible for any secondary costs (e.g., rental cars, loss of wages) resulting from such delays.
- Right to Refuse: We reserve the right to refuse service if the vehicle contains hazardous materials, illegal items, or if the transport conditions are deemed unsafe for our drivers or equipment.
3. SMS Messaging Service
By providing your phone number and opting in to receive SMS messages from 333Classics (also known as 333 CLASSICS LLC), you agree to these Terms and Conditions regarding our messaging service.
Purpose of Messages:By providing your mobile number, you consent to receive SMS/MMS text messages for the purpose of dispatch notifications, real-time driver arrival updates, coordination of pickup and delivery, and general two-way communication regarding your specific service request.
Message Frequency:Message frequency varies based on the status and complexity of your active towing or transport order.
Opt-Out (STOP): You can opt out of receiving SMS messages at any time by replying STOP to any message we send you. After you opt out, you will receive one additional message confirming your request has been processed, and we will no longer send you SMS messages unless you re-initialize the service.
Help (HELP): If you experience issues with our messaging program, you can reply with the keyword HELP for more assistance, or contact us directly at info@333classics.com.
Costs: Message and data rates may apply based on your mobile carrier’s terms.
Liability: Neither 333Classics nor the mobile carriers are liable for delayed or undelivered messages.
4. Fees, Payments, and Billing
333Classics maintains the following billing and payment policies to ensure professional and fair service delivery:
- Preliminary Quotes and Rate Adjustments: All price quotes provided via our website, phone, or email prior to the physical inspection of the vehicle and site are preliminary estimates only. These estimates are based solely on the information provided by the Client. 333Classics reserves the right to adjust the final price at the time of service. Reasons for price adjustments include, but are not limited to:
– Inaccurate vehicle description (e.g., modified height, weight, or size).
– Vehicle condition (e.g., inoperable, seized brakes, missing wheels, or steering issues).
– Site accessibility issues (e.g., vehicle located in a tight parking garage, sand, or mud).
– Additional labor or specialized equipment required that was not disclosed during the initial quote.
- Payment Requirement: Payment is due in full at the time of service completion or upon delivery of the vehicle, unless a separate corporate billing agreement has been established in writing.
- Payment Fulfillment: We accept various forms of payment as communicated by our dispatch or drivers. By engaging our services, you agree to pay the final calculated amount, including any applicable taxes, administrative fees, or service surcharges.
- Dry Run and Cancellation Fees: If our driver arrives at the pickup location and the service cannot be performed due to Client error, or if the order is cancelled after the driver has been dispatched, a “Dry Run” fee will be charged to cover operational costs.
5. Vehicle Condition, Inspection, and Liability
333Classics maintains strict protocols for the inspection and handling of vehicles to ensure safety and transparency:
- Inspection and Bill of Lading: At the time of pickup, our driver and the Client (or their designated agent) will conduct a joint inspection of the vehicle. All existing damage will be noted on the Bill of Lading (BOL). Upon delivery, the Client must again inspect the vehicle. Any new damage must be noted on the BOL at the time of delivery. By signing the BOL without noting any damage, the Client acknowledges that the vehicle was delivered in satisfactory condition, and any subsequent claims will be denied.
- Inoperable Vehicles: If a vehicle is inoperable (does not start, roll, steer, or brake), the Client must disclose this during the booking process. 333Classics is not responsible for damage caused by the structural failure of an inoperable vehicle during loading or unloading (e.g., rusted frames breaking, old tires blowing out).
- Personal Property: 333Classics is strictly prohibited from transporting personal household goods inside the vehicle. We are not liable for any personal items left in the vehicle, including loss, theft, or damage to such items, nor for any damage to the vehicle caused by personal items shifting during transport.
- Mechanical and Electronic Functions: Our liability is limited to the physical exterior of the vehicle. We are not responsible for mechanical, electrical, or computer system failures (e.g., engine issues, battery drain, sensors, or alignment) that occur during normal transport.
6. Limitation of Liability and Indemnification
To the maximum extent permitted by applicable law, the liability of 333Classics is limited as follows:
- Cap on Damages: The total liability of 333Classics for any claim arising out of the performance or breach of our services, including but not limited to cargo damage, shall not exceed the total amount paid by the Client to 333Classics for the specific service rendered.
- Exclusion of Consequential Damages: 333Classics shall not be liable for any indirect, incidental, special, or consequential damages. This includes, but is not limited to: loss of profits, loss of use, rental car expenses, lodging, or emotional distress caused by delays or damage.
- Acts of God and External Factors: We are not liable for damage caused by factors outside our control, such as “Acts of God” (storms, hail, floods), road debris (flying stones/gravel), or government actions.
- Indemnification: The Client agrees to indemnify, defend, and hold harmless 333Classics and its employees from any claims, damages, or expenses (including legal fees) arising from the Client’s breach of these Terms or any inaccurate information provided regarding the vehicle or its contents.
7. Governing Law and Arbitration
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
- Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration in Boca Raton, Florida.
- Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between 333Classics and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and you waive the right to participate in a class-action lawsuit.
8. Changes to These Terms
333Classics reserves the right, at our sole discretion, to modify or replace these Terms at any time.
- Notification: If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect by posting the updated version on our website.
- Acceptance: What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
